Temporary Protective Order or TPO
A Temporary Protective Order, or TPO as it is commonly called, is an order of the Court that prohibits one person from having contact with, in any form, another person. Temporary Protective Orders require an act of Family Violence or Stalking before the TPO can be ordered by the Court. The most common situation in which a TPO is issued is where a couple has been involved in an argument that escalated to some form of violence, such as assault or battery. Many times a TPO issues to protect victims of chronic domestic violence.
The applicant, or person seeking the TPO, files a sworn statement with the Court and if this statement is sufficient then the Court can issue a thirty day TPO without ever hearing from the Defendant. Before the expiration of the thirty days the Court will hold a hearing to determine if the thirty day Temporary Protective Order should become a 12 month Temporary Protective Order. If a person violates the terms of a TPO then they are subject to arrest and further prosecution on either misdemeanor or felony offenses depending on the allegations.
